Agreement to Terms

By engaging Ivan's Tree Services ("Company," "we," "us," or "our") for any tree care services, you ("Client," "you," or "your") agree to be bound by these Terms & Conditions. Please read these terms carefully before scheduling any services.

Services Provided

Ivan's Tree Services provides professional tree care services including but not limited to:

• Tree removal and trimming

• Stump grinding and removal

• Emergency tree services

• Tree health assessment and consultation

• Debris removal and cleanup

• Storm damage cleanup

Estimates and Pricing

Written Estimates: All estimates are provided in writing and are valid for 30 days unless otherwise specified. Estimates are based on visible conditions at the time of inspection and may be subject to change if unforeseen circumstances arise.

Pricing Changes: Final pricing may differ from estimates if additional work is required due to hidden hazards, underground utilities, access limitations, or other unforeseen conditions discovered during service execution.

Emergency Services: Emergency services may be priced differently than standard estimates due to urgency, equipment requirements, and availability.

Payment Terms

• Payment is due upon completion of services unless other arrangements have been made in writing

• Accepted payment methods: cash, check, and major credit cards

• A service charge of $35 will be applied to all returned checks

• For large projects, a deposit may be required before work begins

• Unpaid balances over 30 days will incur a monthly service charge of 1.5%

Property Access and Preparation

Client Responsibilities:

• Ensure clear access to work areas for our equipment and personnel

• Mark or identify underground utilities, sprinkler systems, and buried cables

• Remove or protect valuable items in work areas

• Secure pets during service visits

• Provide accurate property boundary information

Access Issues: Additional charges may apply if access is more difficult than anticipated or if special equipment is required.

Permits and Regulations

• Client is responsible for obtaining any required permits before work begins

• We will advise if permits appear necessary, but ultimate responsibility lies with the property owner

• Work may be suspended if proper permits are not obtained

• Client is responsible for compliance with local ordinances and HOA requirements

Liability and Insurance

Our Coverage: Ivan's Tree Services maintains general liability insurance and workers' compensation coverage for our employees.

Property Damage: While we exercise extreme care, tree work involves inherent risks. We are not liable for:

• Pre-existing damage to structures, utilities, or landscaping

• Damage caused by acts of nature during or after our work

• Minor cosmetic damage to lawns from equipment

• Damage to underground utilities not properly marked

Client Property: Client assumes responsibility for damage to their property caused by failure to properly mark underground utilities, provide accurate information, or prepare the work area as requested.

Weather and Cancellations

Weather Delays: Services may be postponed due to unsafe weather conditions including high winds, ice, lightning, or other hazardous conditions. Safety is our top priority.

Cancellation Policy:

• Client may cancel with 24 hours notice without penalty

• Same-day cancellations may incur a trip charge

• We reserve the right to reschedule due to weather, equipment issues, or safety concerns

Warranties and Guarantees

Workmanship: We guarantee our workmanship for 30 days from completion. This covers only defects in our work, not natural events or tree health issues.

Tree Health: We make no warranties regarding tree survival, future growth, or freedom from disease or pest infestation after our services.

No Guarantee Against Natural Events: We cannot guarantee trees will withstand future storms, disease, or other natural occurrences.

Debris and Cleanup

• Standard cleanup includes removal of all debris generated by our work

• We are not responsible for pre-existing debris or materials

• Additional cleanup beyond normal scope may incur extra charges

• Firewood, when left at client's request, becomes property of the client

Safety and Work Standards

• All work will be performed according to industry standards and ANSI A300 guidelines

• Our crews are trained in proper safety procedures and equipment use

• Client agrees not to interfere with work operations or enter work zones during active operations

• Only authorized Ivan's Tree Services personnel may operate our equipment

Limitation of Liability

To the maximum extent permitted by law, Ivan's Tree Services' total liability for any claim shall not exceed the total amount paid for the specific services that gave rise to the claim. We shall not be liable for any indirect, consequential, special, or punitive damages.

Force Majeure

We are not liable for delays or failure to perform due to circumstances beyond our reasonable control, including but not limited to acts of God, weather events, governmental actions, labor disputes, or material shortages.

Dispute Resolution

Governing Law: These terms are governed by Michigan state law.

Resolution Process: Any disputes will first be addressed through good faith negotiation. If resolution cannot be reached, disputes may be submitted to binding arbitration in Oakland County, Michigan.

Modification of Terms

We reserve the right to modify these terms at any time. Updated terms will be posted on our website and will apply to services contracted after the effective date of changes.
